APRIL 2016 – President’s Article by Jill Riley

Redlands Chamber of Commerce Jill Riley President

I recently had family from Colorado visit. They had not been to Redlands in more than 12 years. While here they stayed at the local Ayres Hotel. The service was wonderful!

I realized sometimes our lives get so busy and we are in such a hurry to get everything done that we don’t get to enjoy all the beauty Redlands has to offer. I took them to Kimberly Crest, Prospect Park, Morrie Mansion, Burgess Mansion, and the Lincoln Shrine; just to name a few of our stops over the visit. We walked down State Street and drove through Redlands to look at all the Victorian homes. We also stopped at an orange stand so they could purchase fresh oranges. We visited many local restaurants and of course went shopping.

Although Redlands has grown since their last visit, they still felt the small hometown feeling Redlands is known for. It made me thankful for the town I live in. It also made me remember all the opportunities that are in our town. I encourage you to revisit Redlands enjoy some of the places that we may forget are important to our community. You’ll be glad you did.

APRIL 2016 – Top Ten Things Employers Do to Get Sued

Employers’ most important tool of operation to keep them out of Labor Board Hearings and courtrooms is information. For the next several months a series of “must know” facts about employment issues will be published in the chamber newsletter. The information was provided CalChamber HR Specialists.

Things employers DO to get sued

Make everyone an “independent contractor” because having employees is too much trouble.

Just because you want the employee to be one, or because the employee prefers independent contractor status, does to make it so. This is another area of the law just ripe for claims and/or litigation. The “independent contractor” is quite happy until money is an issue – such as a workers compensation claim, unemployment insurance, state disability insurance or paid family leave benefits. Another problem scenario is when the Franchise Tax board or the Internal Revenue Service ant tax money, but the “independent contractor” hasn’t been paying his/her quarterly payments, owes lots of money, can’t be found or has no assets. The employer has money and failed to make the require tax withholdings – so now the employer owes.

Independent contractor status does not have a fixed definition by all the government entities that may have a claim for money owed. The primary determining factor is degree of control; who determines the manner in which the work is performed, how it is performed, who supplied the tools or equipment and where the work is performed.

Also important in determining employee or independent contractor status is whether the work is a regular part of the employer’s business. If your company makes a product and you hire an independent contractor to help make the product, chances are the individual is an employee. But if you make a product and you hire someone to paint your building, that person is an independent contractor.

Don’t bother providing training about harassment and discrimination to managers and supervisors. They won’t need the information.

The best defense you have against discrimination or harassment complaint is usually your first-line supervisors, because they are the eyes and ears of the organization. Invest in training on topics such as sexual harassment, discrimination, disability, and safety and wage-and-hour laws if you want to provide an additional layer of protection from lawsuits. Employers with 50 or more employees are required by law to provide two hours of training on sexual harassment for their supervisors. This training must be conducted every two years.

APRIL 2016 – Caltrans I-10 Freeway Improvements

I-10 Freeway to undergo improvements creating 55 hour weekend lane shut-downs

The I-10 Redlands Pavement Replacement Project, will construct pavement improvements on both east and westbound lanes on Interstate 10 between Ford Street in Redlands and Live Oak Canyon in Yucaipa. The Project will replace concrete in the number 3 and 4 traffic lanes, as well as performing spot replacements in the number 1 and 2 traffic lanes. The purpose of the Project is to improve safety for users of Interstate 10, as well as to improve the ride quality of the Interstate. The Project is anticipated to begin in April and have a construction time of 12-15 months.

In order to construct the improvements, Caltrans is anticipating a series of 55 hour shutdowns over 28 weekends. While the project schedule is not final at this point, the closure of the number 3 and 4 traffic lanes for 14 weekends on both eastbound and westbound I-10 is expected. The shutdowns will occur from 9pm Friday evenings until 4am Monday mornings. In order to provide 3 travel lanes for both east and westbound traffic at all times, work will not occur concurrently on eastbound and westbound lanes. Additionally, the provision of 3 travel lanes will require a median crossover detour where the existing median divider will have to be demolished to enable crossover traffic. As opposed to the closure of the number 3 and 4 lanes, the closure of the number 1 and 2 traffic lanes will occur during weeknights.  The schedule for these shutdowns will occur from 9pm to 4am the following morning.

Caltrans will have the lanes open at 4am after every closure. In order to ensure this occurs, a contingency plan is in place where backup equipment will be stored on site and an asphalt plant running throughout the nights of closures will be in place. Caltrans will provide an updated schedule as the Project gets closer to construction commencing. *
